Acceptable Use Policy

This policy sets out what you may and may not do with Sitepur and the sites you build on it.
1. Purpose and scope
This Acceptable Use Policy (the "Policy") governs your use of Sitepur (the "Service") and all content that you create, upload, publish, host, or serve through the Service, including your site and any pages, media, files, forms, and data associated with it. The Service copies a chosen design into your account, hosts the resulting static website, and lets you edit its content.
This Policy forms part of, and is incorporated by reference into, the Terms of Service. Capitalised terms that are not defined here have the meaning given to them in the Terms of Service. Where this Policy and the Terms of Service conflict, the Terms of Service prevail. This Policy applies to you (the "Customer"), to any person you permit to access your account, and to visitors whose activity you control or enable.
We may update this Policy from time to time in accordance with Section 9. Your continued use of the Service after an update takes effect means that you accept the updated Policy.
2. Prohibited content
You are responsible for all content on your site. You must not create, upload, publish, host, link to, or otherwise make available through the Service any content that falls within the categories below.
- Unlawful content. Content that is unlawful under any law that applies to you or to us, including the laws of India, or that promotes, facilitates, or instructs others in unlawful conduct.
- Infringing content. Content that infringes the copyright, trademark, patent, trade secret, design right, or other intellectual property right of any person, or that misappropriates another person's name, likeness, or goodwill.
- Obscene or adult content. Obscene material, and sexual or adult content where such content is prohibited by law or is served without the age verification and consent that the applicable law requires. Content that sexualises minors in any form is strictly prohibited and will be reported to the competent authorities.
- Hateful, harassing, or violent content. Content that incites or promotes hatred, discrimination, harassment, self-harm, or violence against any person or group on any protected ground, or that threatens, bullies, or intimidates any person.
- Malware and deceptive content. Malware, viruses, worms, trojans, ransomware, or other harmful code; phishing pages; content designed to deceive visitors into disclosing credentials, payment details, or personal data; and fraudulent, misleading, or scam schemes.
- Content that violates privacy. Content that discloses another person's personal or sensitive personal data without a lawful basis or the consent that the law requires, and content that facilitates stalking, doxxing, or unlawful surveillance.
- Content prohibited under Indian law. Content that is unlawful under the Information Technology Act, 2000 and the rules made under it, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, such as content that threatens the sovereignty, integrity, defence, or security of India, or public order, or that is defamatory, or that is otherwise prohibited by law.
3. Prohibited activities
When you use the Service, you must not engage in, or permit any other person to engage in, the following activities.
- Unauthorised access or hacking. Accessing, or attempting to access, any account, system, network, or data that you are not authorised to access, or defeating or attempting to defeat any security or authentication measure.
- Scanning or probing. Port scanning, vulnerability scanning, penetration testing, or otherwise probing our infrastructure or that of any third party without our prior written consent.
- Overloading or disrupting infrastructure. Denial-of-service or distributed denial-of-service activity, deliberately generating disproportionate load, or otherwise disrupting or degrading the Service or the experience of other customers.
- Scraping. Using automated means to harvest, index, or copy content or data from the Service or from other customers' sites in a manner that violates their terms or applicable law.
- Reselling or sublicensing. Reselling, sublicensing, renting, leasing, or otherwise making the Service available to third parties as your own hosting or website service, except as the Terms of Service expressly permit.
- Circumventing usage or plan limits. Evading, or attempting to evade, any usage quota, rate limit, storage limit, bandwidth allowance, feature restriction, or plan limit, including by operating multiple accounts to do so.
- Spam and unsolicited bulk email. Sending spam or unsolicited bulk or commercial email, or using your site or any connected service to support such activity, or maintaining content referenced in spam sent by any means.
- Cryptomining. Mining cryptocurrency, or running any comparable resource-intensive computation, using the Service or the resources allocated to your site.
- Impersonation. Impersonating any person or entity, or misrepresenting your affiliation with any person or entity, including us.
4. Your responsibility for your site
Your site is your publication. You are solely responsible for its content and for how it operates, and you must meet the obligations set out below.
- Comply with applicable law. Comply with the laws and regulations that apply to your business and to the visitors you serve, including consumer protection, advertising, e-commerce, data protection, and sector-specific rules in every jurisdiction where you operate.
- Maintain your own visitor terms and privacy notice. Publish and keep current your own terms of use and a privacy notice for your visitors that accurately describes how you collect and use their data. Our Privacy Policy and Cookie Policy describe how we process data as your service provider and do not substitute for your own notices.
- Obtain the consents you need. Obtain and record any consents, permissions, licences, or lawful bases that you need to publish your content and to collect, use, or transfer personal data through your site, including consent for cookies and similar technologies where the law requires it.
5. Fair use of hosting resources
Hosting and SSL are included in your subscription. You must use computing, storage, bandwidth, and other resources reasonably and in a manner consistent with normal operation of a small-business website.
- If your usage places a disproportionate load on shared infrastructure, or affects the stability or performance of the Service for other customers, we may contact you to discuss your usage and to agree on reasonable steps, which may include moving you to a different plan.
- We describe resource allowances by reference to the plan you purchase. We make no "unlimited" promise, and any allowance stated for a plan is the limit that applies to that plan.
- Where usage is abusive, or where it threatens the integrity or availability of the Service, we may act under Section 8 without prior notice to protect the Service and other customers.
6. Copyright and other intellectual property complaints
We respect intellectual property rights and expect you to do the same. If you believe that content hosted through the Service infringes your copyright or other intellectual property right, you may report it to us through our contact form at sitepur.com/contact.
Your notice should include the following so that we can act on it.
- Identification of the work or right that you say has been infringed.
- The specific infringing URL or a description sufficient to locate the material on the site.
- Your contact details, including your name, postal address, email address, and telephone number.
- A statement, made in good faith, that you believe the use of the material is not authorised by the rights holder, its agent, or the law.
- A statement that the information in your notice is accurate, and that you are the rights holder or are authorised to act on the rights holder's behalf.
- Your physical or electronic signature.
On receipt of a complete notice, we may remove or disable access to the material and notify the Customer who published it. That Customer may submit a counter-notice through our contact form at sitepur.com/contact that identifies the material, states under penalty of the applicable law that the Customer has a good-faith belief that the material was removed as a result of mistake or misidentification, and provides the Customer's contact details and consent to the applicable jurisdiction. Where the law allows, we may restore the material after a reasonable period unless the original complainant pursues a legal remedy. This notice and counter-notice process follows the approach of the United States Digital Millennium Copyright Act and comparable regimes.
In addition, you may pursue the grievance route under the Information Technology Act, 2000 and the rules made under it by contacting our Grievance Officer, [Grievance Officer Name], through our contact form at sitepur.com/contact. We will acknowledge a grievance within the period prescribed by law and resolve it within the timelines that the applicable rules set.
7. Reporting abuse
If you become aware of content or activity that breaches this Policy, please report it to us through our contact form at sitepur.com/contact. Where you can, include the relevant URL, a description of the issue, and any information that helps us assess and act on the report. We review reports and take the action that we consider appropriate under Section 8.
8. Consequences of violation
Where you breach this Policy, we may take one or more of the following actions, having regard to the nature and severity of the breach, whether it is repeated, and the risk to other customers, to visitors, and to the Service.
- Warning. We may notify you of the breach and ask you to correct it within a stated period.
- Content removal. We may remove or disable access to the offending content.
- Suspension. We may suspend your site or your account, in whole or in part. Where we suspend a site, your static files and content data are retained in accordance with the Terms of Service and are not deleted by reason of suspension alone.
- Termination. We may terminate the Service for serious or repeated breaches, in accordance with the Terms of Service and the Refund and Cancellation Policy.
- Referral to authorities. We may report activity to, and cooperate with, law enforcement, regulators, and other competent authorities where we are required to do so or where we reasonably consider it appropriate.
Where a breach threatens the security, integrity, or availability of the Service, or exposes us or other customers to legal liability, we may act without prior notice. We will give you notice as soon as it is reasonable to do so.
9. Changes to this Policy
We may amend this Policy to reflect changes in the Service, in applicable law, or in our operational practices. We will post the amended Policy on this page and update the "Last updated" date. Where a change materially reduces your rights or materially increases your obligations, we will take reasonable steps to bring it to your attention. Your continued use of the Service after the change takes effect constitutes acceptance of the amended Policy. This Policy should be read together with the Terms of Service, the Privacy Policy, the Cookie Policy, and the Refund and Cancellation Policy.

This Policy is governed by the laws of India, and it also reflects our obligations to visitors and customers protected by the EU and UK General Data Protection Regulation and the California Consumer Privacy Act as amended by the California Privacy Rights Act. Payment processing, invoicing, and applicable sales tax, VAT, and GST are handled by our third-party merchant of record.
